《关于适用<中华人民共和国婚姻法>若干问题的解释(三)》第七条 婚后由一方父母出资为子女购买的不动产,产权登记在出资人子女名下的,可按照婚姻法第十八条第(三)项的规定,视为只对自己子女一方的赠与,该不动产应认定为夫妻一方的个人财产。由双方父母出资购买的不动产,产权登记在一方子女名下的,该不动产可认定为双方按照各自父母的出资份额按份共有,但当事人另有约定的除外。
第十条 夫妻一方婚前签订不动产买卖合同,以个人财产支付首付款并在银行贷款,婚后用夫妻共同财产还贷,不动产登记于首付款支付方名下的,离婚时该不动产由双方协议处理。依前款规定不能达成协议的,人民法院可以判决该不动产归产权登记一方,尚未归还的贷款为产权登记一方的个人债务。双方婚后共同还贷支付的款项及其相对应财产增值部分,离婚时应根据婚姻法第三十九条第一款规定的原则,由产权登记一方对另一方进行补偿。

恋人双方的名字如果采用这种方案,房屋将被认定为男女双方的共有财产,贷款也认定是男女双方的共同债务。如无“借条”等其他证据,父母的出资将被认定为赠与男女双方,归双方共有。如果购房后“准夫妻”分手,那么“准婚房”仍将认定为双方共有财产,贷款也视为双方的共同债务。对于父母的出资,如果有相应证据显示父母出资是基于“准夫妻”双方结婚的目的,法院也会认定这部分出资是一种附加条件(双方结婚)的赠与,若双方没有结婚,父母有权索回。

署父母的名字若这样署名,房屋将被认定为父母的财产,贷款也认定为父母的债务,相应的增值或贬值也由父母享有或承担。如果结婚后夫妻双方用婚后的收入还贷,若双方离婚,一方虽无法拥有房屋,但对于已支付的贷款本息,可要求父母返还或主张分割房产。
署男方及其父母的名字如果这样操作,房屋将被认定是男方及其父母的共有财产,贷款也是他们的共有债务,相应的增值或贬值由他们共同享有或承担,而男方的相应产权份额属于婚前个人财产,根据《婚姻法》,这部分财产不会因结婚而转化为夫妻的共有财产。如果婚后夫妻双方用婚后的收入还贷,若双方离婚,女方虽无法主张房屋产权,但对于已支付的贷款本息可主张为夫妻共同财产,要求男方及其父母返还或主张分割房产。产权证登记在女方及其父母名下的法律后果亦是如此。
写双方父母和“准夫妻”的名字很多人认为,与其那么麻烦,不如把双方所有人都登记到产权证上,这样大家都有权利,公平合理。若采用这种方案,房屋将认定是准夫妻和双方父母的共有财产,贷款也认定为其共有债务,相应的增值或贬值也由这些人共同享有或承担。如果婚后仅用夫妻双方的婚后收入还贷的,双方离婚,对于已支付的贷款本息可主张为夫妻共同财产,双方父母则无权享有该部分财产。
仅署男方或女方的名字此种情况需从两方面分析:其一,一方或一方的父母出资,仅仅登记在该方子女的名下,根据《婚姻法》的规定,这属于该方子女的婚前个人财产,结婚后也不会自动转化为夫妻共同财产,若出现离婚,该房产仍属于原产权人;其二,一方或一方的父母出资,但登记在未出资的另一方名下,法院通常认定为一种附条件的赠与行为,如果双方未结婚,该房屋属于产权证上所载一方的名下,但对方可以要求返还已支付的款项。如果双方结婚,则属于产权证下该方的个人财产。(法制晚报:fzwb_52165216)
